How we use personal data
Using personal data for our and our Customers’ legitimate interests
We use personal data to develop, improve, test and deliver our products and services, to help our Customers to onboard and integrate their customers, price and underwrite insurance policies, check and manage the identities of people applying for policies, support them in meeting their regulatory compliance obligations, manage the policy and any claims made under the policy and to identify potential fraud.
Our legitimate interest is, therefore, in facilitating the provision of our products and services to the insurance industry through recognition of our Customers’ need to quickly and accurately assess insurance risk, meet their compliance obligations, for policy and claims management and to reduce the likelihood of fraud. We do this by making comprehensive, consistent and accurate data available to the insurance market in a cost-effective way, irrespective of our Customers’ sales channel.
We do not decide the price of insurance policies or make any decisions on behalf of our Customers; our Customers do this independently. The products and services we provide to our Customers, as described in this Privacy Notice, are just one of the factors that our Customers consider when making a decision about you and we only permit our Customers to use the data we provide for the purposes described in this Privacy Notice.
We have set out more information about how our products and services are used for these legitimate business interests in processing personal data below:
Purpose | How is personal data used and why? |
To match and link your personal data records |
LexisNexis® LexID for Insurance This can be assigned to each of our Customer’s consumers’ records across their different data systems, enabling our Customers to create a connected view of their customers throughout the insurance policy lifecycle. This in turn allows them to improve their customer experience and gain operational efficiencies by linking together data related to, for example, different product holdings you have with that insurer. We use proprietary linking technology to match identifying data, such as name, address, and date of birth, across different data sources, as described in the section What personal data is collected and from whom it is obtained, in order to assign the unique LexID to consumer identities. |
To assist our Customers in verifying data you provide, assessing insurance risk, managing your insurance policy or insurance claim and preventing fraud |
No Claims Discount Module for LexisNexis® Policy History Motor The No Claims Discount Module helps our Customers in their validation of your entitlement to a discount for not having previous claims by comparing the information you provide to our Customers with the No Claims Discount history collated and shared from other Customers. |
LexisNexis® Policy Insights If you’re a proposer, a policyholder, or a named driver, Policy Insights provides information to Customers about your previous motor insurance policies so you can obtain a quote for insurance and in support of managing your policy and any claims you may make. We use information contributed to us by other insurers and brokers such as where you live, vehicle information and previous insurance policies to analyse your motor insurance history and to provide facts that are useful to insurers for assessing and predicting future risk. |
|
LexisNexis® Risk Insights Risk Insights can assist our Customers in understanding any risks associated with home, motor, commercial or other general insurance applicants or claimants. It does this by identifying, summarising and reporting on the presence or absence of certain public data such as county court judgment and insolvency data; data that may be accessed under the Open Government Licence in respect of the area in which you live, such as crime and unemployment data; and other data sources as described in the section What personal data is collected and from whom it is obtained. |
|
LexisNexis® Risk Insights Score Risk Insights Score uses some of the data from the LexisNexis® Risk Insights dataset to create an insurance risk score. Insurers may use this at quote or renewal or when you make a claim as one of the factors to help inform their risk assessment. This score is a value between 200 and 997, with the highest scores representing the lowest risk to the insurer. This will include information such as your presence on the Open Electoral Register, county court judgment information and general indicators about the area in which you live, for example house prices, crime, and unemployment figures. |
|
LexisNexis® Attract™ for Motor Attract for Motor uses some of the data from our LexisNexis® Policy Insights and LexisNexis® Risk Insights datasets to create an insurance risk score. Insurers may use this at quote or renewal or when you make a claim as one of the factors to help inform their risk assessment. This score is a value between 200 and 997, with the highest scores representing the lowest risk to the insurer. This will include information, such as how long you have continuously held an insurance policy, your presence on the Open Electoral Register, county court judgment information and general indicators about the area in which you live, for example house prices, crime, and unemployment figures. |
|
LexisNexis® Vehicle Build Vehicle Build allows our Customers to better understand the presence and type of vehicle safety features fitted to a declared vehicle. Vehicle Build standardises and classifies the numerous vehicle data points, as supplied by third party data partners including vehicle manufacturers, into a common classification using the specific Vehicle Identification Number (VIN). Insurers will share that VIN or Vehicle Registration Number (VRN) with us to assist them in detecting the presence of vehicle features on that vehicle so they may use this to assess the risk associated with that vehicle. |
|
LexisNexis® Vehicle Insights Vehicle Insights allows our Customers to better understand details about the vehicles they insure so that they can provide the most appropriate cover. Linked to the VRN (Vehicle Registration Number), vehicle details and associated insight is provided on the vehicle make, model, type and age, together with keeper changes and details recorded as part of the vehicle registration process. Where a specific Vehicle Manufacture has applied updates to improve vehicle security, this can be included. Road Tax (Vehicle Excise Status), Ministry of Transport (MOT) status and MOT history data is provided as made available under the Open Government License. Certain data fields are calculated or modelled to help our customers consume the data and derive insight from it. The vehicle valuation and estimated mileage is provided as they are important factors in calculating insurance cover and premiums. Information is provided based upon the VRN supplied by our customer. |
|
LexisNexis® Quote Intelligence Quote Intelligence identifies certain potentially unexpected, unusual or inconsistent connections and declarations, either between quotes or between individuals named on quotes, undertaken by you over the previous 90 day period. When you apply for insurance, and our Customers engage us, we obtain information about your quote requests, which we use to help our Customers separate normal shopping behaviour from potentially fraudulent or higher risk behaviour. For example, it is accepted that different levels of voluntary excess payable on a policy may be selected in order to obtain a more favourable premium. However, some behaviour is not normal and could lead to an applicant fraudulently obtaining insurance at an unreasonably low price, such as inputting different dates of birth for the same person on different quote requests. This data includes, for example: date of birth, address, declared previous claims. We do not determine whether these differences, or the number of changes, are of importance to an insurance provider or whether it should affect the premium offered or insurance terms. Quote Intelligence simply notifies the insurance provider of information related to previous applications. |
|
LexisNexis® Informed Claims - Linked Addresses and Alias Names Linked Addresses and Alias Names is a data source used by LexisNexis to support our Customers in their assessment of insurance risk and in the prevention of fraud. Linked Addresses and Alias Names identifies other addresses or names held within our databases and previously used by you that differ from that provided in your request for a quote for insurance, or when you make a claim. |
|
LexisNexis® Property Insights LexisNexis Property Insights helps our Customers better understand and evaluate the presence of different property features, and the associated risks, of a residential property that is the subject of an insurance policy. Insurers will share that address with us so we can assist them in identifying the main features of the property to be insured, in the event of a change to the policy, or a claim being made. The insurer may also use this data to prefill application forms to give you a simpler and shorter application through verification of data, or they may compare the data returned with your declarations. |
|
LexisNexis® Indicium and Consumer Plus Insurers may use this at quote or renewal as one of the factors to help inform their risk assessment. The score is a numeric value that is scaled according to the likely risk presented by an individual with the highest scores representing the lowest risk. We use information from data we access on behalf of our Customers to create an overall risk score that insurers may use as one factor to help them assess the price they offer for home, motor, commercial or other general insurance. The data included in these scores will differ by insurance provider but may include whether you have previously had a county court judgment or been bankrupt as well as other non-financial information from credit reference agencies and/or other commercially available indicators, such as the known demographics in the neighbourhood where you live. |
|
LexisNexis® Geospatial Intelligence and LexisNexis® Map View
When you request a quote for property or motor insurance - whether this be through a price comparison site, broker or insurer website or by an enquiry made through a call centre or branch - that insurance provider will share that address with us to assist them in identifying the main geospatial features (for example, the presence of flood or subsidence risk) of the location where that property or vehicle are located. |
|
LexisNexis® Precision Claims for Home We provide personal data that helps insurers and brokers to make more informed underwriting and pricing decisions about home insurance policies, by providing information about the subject’s previous insurance claim history. We use information contributed to us by other insurance organisations such as where individuals live and previous insurance claims to analyse their historical insurance behaviour and to provide facts that are useful to insurers for predicting future risk. Each insurer will have its own criteria to assess what insurance cover to offer and what premium to set – and they use various factors to help them including the data we provide. We only permit our Customers to use this data to administer new and existing insurance claims as well as help prevent fraud and decide whether to offer insurance and, if so, what level of cover to offer and at what premium. |
|
LexisNexis® Precision Claims for Motor We provide personal data that helps insurers, brokers, and other intermediaries and third parties, to make more informed underwriting and pricing decisions about Motor insurance policies, by providing information about the subject’s previous insurance claim history. We use information contributed to us by other insurance organisations such as where individuals live and previous insurance claims, to analyse their historical insurance behaviour and to provide facts that are useful to insurers, brokers and other intermediaries and third parties for predicting future risk. Each insurer, broker and other intermediaries and third party will have its own criteria to assess what insurance cover to offer and what premium to set – and they use various factors to help them including the data we provide. We only permit our Customers to use this data to administer new and existing insurance claims as well as help prevent fraud and decide whether to offer insurance and, if so, what level of cover to offer and at what premium. |
|
LexisNexis® Emailage® Rapid
LexisNexis also provides services offered by an Emailage Affiliate that is a LexisNexis Risk Solutions company, part of the RELX Group™ of companies. Emailage Rapid provides two scores, one for identity validation and one for risk assessment. The identity validation score called a ‘Digital Confidence Score’ also known as ‘DCS’. DCS gives confidence score based on pairs of inputs, email and shipping address and generates an overall confidence score 1-100. The higher the score, the higher the level of confidence that these inputs belong to the same digital identity. The risk assessment score focuses on the data within Emailage creating an overall score-based factors such as domain name and the creation date of the email address. For further information please refer to https://risk.lexisnexis.com/corporate/processing-notices/emailage |
|
Vehicle Risk Data When linked to the VRN (Vehicle Registration Number), Vehicle Risk Data lets our Customers quickly and accurately identify and characterise the vehicle when quoting for an insurance policy. Vehicle Risk Data is provided as either a batch file, or transactionally linked to the VRN supplied by our customer. |
|
Developing our statistical models, testing and evaluating our products and services |
We use personal data for statistical analysis to develop our products and services, including risk scores. To do this, we compare policy, quote, claims and other information about you against other variables such as your previous claims and policy history in order to help insurers to manage your claims, better predict insurance risk and to identify potential fraud. We allow our Customers to evaluate our products and services through data analysis to help develop and improve products, to ensure that they will meet their needs and to help them determine how they will use the products and services we provide in their future decision making processes. We use data to test our products with a representative sample of real identities to ensure they are working correctly and provide accurate results to our customers. Without being able to include a representative example of real data, we risk not being able to test full scenarios to ensure existing products are functioning as expected and leaves us open to missing relevant information that may have a negative impact on customers and data subjects. |
Protecting our legitimate business interests and legal rights |
Where we believe it is necessary to protect our legal rights, interests and the interests of others, we use personal data in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business. |
Where required by law |
In exceptional circumstances, we may be required by law to provide personal data to law enforcement agencies, courts or others in connection with claims and other litigation. |
Using special category personal data and personal data relating to criminal offences, for reasons of substantial public interest
Where LexisNexis Risk Solutions processes details of convictions, e.g., driving-related or non-driving-related offences, a DVLA notifiable medical condition and pre-defined accident codes, we can only process information relating to criminal convictions or the presence of a medical condition, where we have an additional, specific lawful basis to process such information.
For this processing, we rely upon reasons of substantial public interest, insurance purposes – assisting our customers in their assessment for the purpose of arranging underwriting and administrating contracts of insurance, administering claims under a contract of insurance and exercising rights, or complying with obligations that arise in connection with contracts of insurance.
Our customers could not achieve the above objectives without the specialist services offered by third party providers such as us. A data subject applying for a product or service with one of our business customers would expect background checks to be carried out during their applications and would be informed so by our business customer (the data controller) at point of application. Therefore, we believe there is a clear and specific legitimate interest, that we have demonstrated necessity and objectively considered the balance of interests.
If you would like more information about the factors we considered you can ask us using the contact us information below.
LexisNexis® Risk Solutions products that use profiling or automated decision-making by our CustomersAutomated processing of personal data to evaluate certain personal aspects relating to an individual, particularly to analyse or predict aspects concerning that individual, is considered profiling under the applicable data protection laws.
While our products do use profiling as part of our Customers’ insurance risk analysis.
Profiling is not the same as an automated decision-making and we don’t make any decisions about you, automated or not. Our products, including the ones that use profiling, are one factor that our Customers may use in their decision-making about your policy or claim, to assist them in the identification of potential fraud and to more accurately predict risk and determine the premium and underwriting terms of your insurance policy.
